Colorado’s Producer Responsibility Program for Statewide Recycling has moved from planning into implementation. The state’s law covers packaging materials and paper products, and the state-appointed Producer Responsibility Organization, Circular Action Alliance, now provides registration, reporting and programme resources. A frame factory can support the evidence, but it cannot decide which U.S. company is the producer.
This guide is for private-label display-frame brands, importers, retailers, ecommerce operators and procurement teams selling certificate frames, jersey displays, medal shadow boxes, vinyl record displays or related products into Colorado. It explains a practical buyer–supplier handover. It does not determine producer status, covered materials, exemptions, fees or compliance, and it is not a substitute for Colorado law, current CAA instructions or qualified U.S. counsel.
Begin with the company, brand and sale route
Map the legal entity whose brand appears on the frame or packaging, the manufacturer, importer, distributor, retailer, marketplace seller and fulfilment provider. Show which company is located in the United States and which one supplies the packaged product in Colorado. Use legal names and contracts rather than assuming that the factory named on an invoice is the obligated producer.
Create separate maps for store sales, wholesale distribution, direct ecommerce and marketplace fulfilment. One brand may use different importers or pack configurations by channel. Keep the producer analysis with the U.S. business and its adviser. Ask the factory for physical pack facts, not a legal conclusion that it is “Colorado compliant.”
Address registration before debating the perfect dataset
CAA states that Colorado regulations required producers to register by 1 October 2024 and that producers who missed the deadline should still register and report. Its current registration page also notes that, from 1 July 2025, a producer may not sell or distribute products using covered materials in the state unless participating in the programme, subject to the law’s alternatives and exemptions.
If the business has not completed screening, escalate it now. Do not wait for a supplier to finish every gram of packaging data before determining whether the entity should contact CAA or counsel. Registration, participant agreements, reporting and fees are distinct steps. Record who owns each action and keep portal credentials with the responsible producer, not with an overseas vendor.
Separate legal participation from supplier evidence
The Colorado producer or its authorised representative controls registration, accepts programme terms, submits data and pays assessed dues. The supplier controls the approved physical specification, component identities, finished weights, production revision and shipment evidence. A third-party fulfilment operator may control the parcel carton added in the United States. Make those information boundaries explicit.
A useful RACI assigns the brand or importer responsibility for legal analysis and Colorado quantities; the factory responsibility for product-packaging BOM accuracy; fulfilment responsibility for outbound shipping packs; finance responsibility for invoices and accruals; and legal or sustainability responsibility for exemptions and current programme interpretation. Shared accountability without a named owner usually produces missing or duplicated data.

Inventory every covered-material candidate
Start with a complete physical list: retail carton, presentation box, glazing film, bag, tissue, moulded-fibre or foam corners, accessory pouch, labels, tape, printed inserts, grouped master carton, parcel carton, void fill and pallet materials. Do not delete a line because it seems non-recyclable or too small. Coverage, recyclability, fee category and minimum-recyclables lists answer different questions.
Record the component function, material family, sub-material, finished mass, dimensions, supplier and use level. Keep raw descriptions such as “expanded polyethylene corner, 32 kg/m³ nominal density” beside the reporting code selected by the producer. If CAA changes a category or template, the buyer can remap reliable source data instead of asking the factory to reconstruct old production.
Distinguish original product packaging from shipment packaging
A display frame can leave the factory in a fitted retail pack, reach a U.S. warehouse in a master carton and later receive a separate courier carton with void fill. The brand may control the first pack while a marketplace or fulfilment centre controls the last. Draw the packaging stack by location and owner, not merely by “inner” and “outer.”
Request the factory BOM for everything applied before export. Obtain average parcel-pack data from the U.S. fulfilment operator by order type and frame size. If several products share one shipment, document the allocation method. Do not copy factory weights into the ecommerce shipping lines when that packaging is selected thousands of kilometres later.
Weigh approved production components
Use a calibrated or verified scale appropriate to the component. Tare containers, define sample count and record unit. Batch-weigh labels or films that fall below reliable single-item resolution. Photograph the component and reading, and save the result with pack code, date, operator and affected SKUs. For cartons, note board construction and any meaningful variability.
Engineering estimates can support an early forecast, but label them as estimates. Replace them with production-equivalent evidence before the producer’s reporting close. Avoid zeros for unknown items. An unresolved weight should remain visibly open with an owner and due date so that it cannot silently reduce the data set.
Connect packaging revisions to Colorado units
The factory’s shipment quantity is not the same as the number supplied in Colorado. Frames can remain in national inventory, sell in another state, be returned, repacked or bundled. Build a calculation that connects mass per packaging revision to Colorado units by SKU, channel and reporting period. Retain the source sales and fulfilment records used.
Control effective dates carefully. If a carton changed in May but old stock shipped through July, a simple annual average can be wrong. Use lot, receipt or shipment records to assign the right configuration. Document assumptions where exact allocation is not possible, and have the producer approve the method. The factory should provide the change date and affected shipment lots; the U.S. seller supplies destination data.
Review exemptions at entity level
Colorado includes exemptions, including provisions that can depend on producer size or material circumstances. The producer and its adviser should review the current statute, regulations and CAA guidance using organisation-wide facts. A small shipment of frames does not automatically make a large brand exempt, and an overseas supplier cannot establish an exemption from one purchase order.
Keep the analysis with the reporting year, source financial or quantity records, reviewer and approval date. Recheck after acquisitions, channel growth or changes in the legal entity that owns the brand. Do not ask the factory to sign a blanket exemption statement. It can certify physical data within its knowledge, such as units shipped and packaging composition.
Plan for fees without inventing a rate
CAA describes fee setting as state-specific and material-sensitive, with commodity revenue, programme costs and eco-modulation among the principles. Procurement should not build a landed-cost promise from an old webinar slide or another state’s fee. Finance should monitor the current Colorado schedule and apply it to the producer’s accepted data and period.
Use scenario planning: show material mass, expected Colorado units and an explicitly provisional fee input controlled by finance. Keep supplier price and EPR dues separate. A lower carton price does not establish a lower programme fee, and a reported material change can affect both protection performance and contribution exposure. Approve redesign through a cross-functional review.
Make recyclability claims a separate decision
A material appearing on a collection list does not automatically justify an unqualified consumer claim. Collection, sorting, end markets, component separability and claim rules must be evaluated separately. Keep the supplier file factual: material, coating, colour, adhesive, dimensions, separability and recycled content evidence where requested.
If the brand wants “recyclable,” “made with recycled content” or similar wording, route it to the responsible claims reviewer with current evidence. Do not ask the factory to add a recycling symbol because a competing carton has one. Packaging EPR participation is not a certification of the product or a marketing endorsement.

Control marketplace and fulfilment changes
A move from seller-fulfilled to marketplace-fulfilled orders can change the parcel carton, void fill, label stock and entity that applies them. Add fulfilment configuration to the annual review and to new-channel launch checklists. Obtain a defined data source from each warehouse instead of assuming that all sites use one pack algorithm.
Keep a channel matrix with frame SKU, original product pack, fulfilment location, outbound pack rule, responsible data owner and effective period. When the warehouse right-sizes cartons, preserve the old method for earlier transactions. The producer should be able to explain what packaging was used for Colorado orders, not merely what its standard operating procedure says today.
Use supplier change control before substitutions
Require approval for changes to material, gauge, board grade, dimensions, adhesive, colour, recycled content claim, grouped quantity or protective design. The change request should include old and new specifications, weight impact, test result, effective lot and remaining stock. Notify the producer’s reporting owner before commercial use.
Emergency substitutions need the same record even when approval is accelerated. A foam corner used for two weeks should not disappear because it was temporary. If two configurations ship in one period, keep both. A controlled packaging history supports reporting, quality investigations and future redesign without forcing either party to guess.
Inspect received packs against the BOM
At first receipt and after a change, unpack selected frames in sequence and compare every component with the approved record. Check the fitted retail pack, films, corners, accessory bags, labels, master cartons and any warehouse-added materials. Weigh a sample where variance is important and photograph discrepancies.
Decide whether the difference affects shipment release, supplier correction, data revision or earlier reporting. Do not silently edit the master mass. Record the reason, affected lots and approval. Incoming checks connect the factory’s specification with the pack consumers and recycling systems actually receive.
Maintain an annual evidence file
Archive registration status, participant agreements, CAA instructions, packaging BOMs, scale records, change approvals, Colorado units, fulfilment data, exemption reviews, submissions and fee records by period. Save the version of the template or guidance used. Do not overwrite a prior-year calculation when the programme evolves.
Set a review calendar for new SKUs, channel changes, packaging redesign and reporting close. Ask CAA or qualified advisers for questions the public materials do not resolve. A well-organised evidence file is more valuable than a large folder of undated supplier declarations because it shows which facts supported each decision.
Keep access controlled but practical. Sustainability, finance, operations and the authorised submitter should know where the approved file lives and who can revise it. When staff change, transfer the reporting calendar, portal contacts and open data questions. Business continuity is part of compliance readiness; a correct spreadsheet that nobody can locate or explain is not a dependable control.
